While the study states recidivism for crime in general is higher than for sex crimes, it also states recidivism rates underestimate actual rates for reoffending. NPD spokesperson Sarah Jensen said the department doesn’t keep data on reoffenses.

Those figures come directly from the Department of Justice (DOJ) Office of Sex Offender Sentencing, Monitoring, Apprehending, Registering, and Tracking (SMART). Well, that is not exactly a quote. The SMART study says, “[t]he observed sexual recidivism rates of sex offenders range from about 5 percent after 3 years to about 24 percent after 15 years.”
Although not as scary as Justice Kennedy’s “frightening and high” 80%, these numbers are hardly comforting to the general public. Since they come from the DOJ, refuting them is difficult. In discussions about the registry, I’m frequently confronted with those cumulative figures and have no quantifiable response. Does anybody have a good rebuttal?
Do the re-offense rate after 15 yrs. include reporting violations (technical violations, or absconding from the registry)? Or are they new sex offenses? Makes a tremendous difference, in my opinion.
